Our construction team attorneys can assist the firm's clients in all aspects of a construction project planning and risk allocation, performance, and dispute resolution.  Our clients include the entire range of potential parties to a project.

Planning and Risk Allocation: We understand the iron triangle of construction: quality, cost, and time. We "right size" that triangle through well-drafted contract documents that allocate the myriad of design, financial, insurance, control, and site condition risks. 

Project Performance:  We assist clients in protecting themselves and their claims during project performance, including documenting actual and constructive delay claims; preparing mechanics liens; preparing insurance claims; or in assessing critical decisions such as stopping work, continuing performance, or withholding contract payment.           

Project Dispute Resolution:  Our construction law team assists the firm's clients in both traditional and alternative dispute resolutions. In any dispute we seek to understand the client's goals, the likely costs, and the effort required, and to assess realistically the probabilities of an outcome consistent with the client's goals.

  • Advised regional religious organization in identifying and selecting a contract vehicle best suited to accomplishing the group's multi-phase, multi-year construction project for its 360-acre retreat center;
  • Successfully defended general contractor against constructive delay claim brought by major subcontractor;
  • Negotiated and favorably settled on behalf of general contractor a multi-million dollar contract claim by a local municipality on a regional airport project;
  • Negotiated and favorably settled on behalf of general contractor a $1,000,000 tenant restaurant fitout;
  • Successfully prosecuted on behalf of general contractor a contract claim against a large home owners association for the installation of a street lighting system;
  • Successfully prosecuted on behalf of owner a contract claim against a regional custom home builder;
  • Served as local counsel for major Atlanta law firm representing a flooring subcontractor in litigation and favorable mediation of a multi-million dollar claim arising out of a defective flooring system in 1.5 million square foot office complex.
